Part of Lots 31 & 32, Broken Front Concession and Concession 1 Township of Sidney, now City of Belleville, which is within the Belleville urban boundary is commonly referred to as the Village of Avonlea. It is located immediately west of Avonlough Road and north of the CP Railway, it is east of Wallbridge-Loyalist Road and Quinte Christian High School and south of Potters Creek:

It was vacant with agricultural crop fields zoned Agriculture Zone (A2-8) and the Environmental Protection (E) Zone under bylaw 2076-80:

(a) Main Use
(i) a farm, including only existing farm dwellings;
(ii) an existing single detached dwelling; and (3129-95)
(iii) existing uses.
(b) Accessory Uses, Buildings or Structures
(i) Any use, building or structure which is subordinate and customarily incidental to a main use.
(c) Dwellings and Dwelling Units
(i) Notwithstanding Sections 4(7)(a) and (b) of this Part W no single detached dwelling, dwelling unit or farm dwelling shall be erected or located in that area zoned A2-8.
(d) Zone Requirements
The minimum lot area and lot frontage shall be as existing on the date of the passing of this By-Law. The minimum front yard and rear yard depth shall be 7.5 metres and the minimum interior and exterior side yard width shall be 7.5 metres . Notwithstanding the aforementioned, any existing yard having a depth or width less than 7.5 metres shall be recognized for the existing building or structure. The maximum building height shall be 10.5 metres. (3129-95)

The Planning Advisory Committee recommended Council approve upzoning the land to:

  • Residential Third Density (R3-4) Zone
  • Residential Sixth Density (R6-37) Zone
  • Residential Seventh Density (R7-15) Zone
  • Open Space (O1) Zone
  • Environmental Control (E)
  • Zone and Community Facility (CF-13) Zone

under By-law 10245 to facilitate the development of 695 dwelling units, including:

  • 260 single-detached dwellings
  • 36 semi-detached dwelling
  • 91 townhouse dwellings
  • 68 horizontal multiple attached dwellings
  • 8 low-rise apartments containing 96 units in total
  • 3 high density apartment buildings containing 144 units in total

The rezoning application requests to repeal the zoning under Bylaw 2076-80 and zone the subject land entirely under Zoning Bylaw 10245;

RECOMMENDATION REPORT FOR PROPOSED AMENDMENTS TO BELLEVILLE’S LOYALIST SECONDARY PLAN AND ZONING BY-LAWS 2076-80 AND 10245
Meeting

THAT Pursuant to Planning Report PP-2022-24, the Planning Advisory Committee recommends the following to City Council:

THAT Belleville’s Loyalist Secondary Plan, as amended, concerning Part of Lots 31 and 32, Broken Front Concession and Concession 1, Township of Sidney, now City of Belleville, County of Hastings be amended by re-designating portions of Schedule ‘A’ – Land Use Plan to specify the location of the parkland, stormwater pond, and the Environmental Protection lands; Schedule ‘D’ – Stormwater Management Plan to address the extent of the stormwater pond; and Schedule ‘E’ – Transportation and Trail System Plan to modify the location of the proposed Collector Road;

THAT Zoning By-Law Number 2076-80, as amended, be repealed in its entirety for the subject land as shown on Attachment #2; THAT Schedule ‘A’, Map No. 3, of By-Law Number 10245, as amended, be amended by extending the Schedule to include the subject land as shown on Attachment #2;

THAT Zoning By-Law Number 10245, as amended, be amended by rezoning Part of Lots 31 and 32, Broken Front Concession and Concession 1, Township of Sidney, now City of Belleville, County of Hastings from the Agriculture (A2-8) Zone and the Environmental Protection (E) Zone to the Residential Third Density (R3-4) Zone, Residential Sixth Density (R6-37) Zone, Residential Seventh Density (R7-15) Zone, Open Space (O1) Zone, Environmental Control (E) Zone and Community Facility (CF-13) Zone to facilitate the development of 695 dwelling units consisting of single detached dwellings, semidetached dwelling, townhouses, horizontal multiple attached dwellings, and eight low-rise apartment buildings and three high density apartment buildings;

THAT approval of a Draft Plan of Subdivision, prepared by RFA Planning Consultant Inc., dated November 19, 2021, as shown on Attachment #3 to Engineering and Development Services Report No. PP-2022-24, be granted for the lands identified as Part of Lots 31 & 32, Broken Front Concession and Concession 1, Township of Sidney, now City of Belleville, County of Hastings (File: 12T-21002) subject to the draft plan conditions outlined in Attachment #10 to Report No. PP-2022-24.
