New Belleville Land Maintenance Bylaw replaces Bylaws 2011-206 (Littering) and 2014-120 (Property Maintenance) and outlines requirements for maintaining land in a clean and clear condition.

  • Owner of a vehicle from which litter is thrown is presumed liable for littering. This may be rebutted by evidence contrary on a balance of probabilities.
  • Owner of litter identified through its markings is presumed liable for littering. This may be rebutted by evidence contrary on a balance of probabilities.

Fines

Between 2020 and 2025, no fines were collected under the Clean and Clear By-law and Littering By-law.

Set fines are not deployed as a mechanism for revenue generation. Instead, they serve as a
critical tool to maintain compliance and uphold community standards when other measures are ineffective. Ultimately, preference will be given to remedial work with charges and fines
reserved for multiple repeat violations. Based the identified approach, it is anticipated that
revenue generation from set fines will be negligible.
