The subject site has a lot area of approximately 8.23 ha (20.33 acres), with 260 metres of frontage on the south side of Old Highway 2, and 378
metres of shoreline frontage on the Bay of Quinte west of Belleville. The subject property is currently developed with two single detached dwellings, a barn and a shed.
Official Plan change
Seeks to change the policy framework for the subject property to a Site Specific Policy Area which would permit residential development,
specifically a 29 lot subdivision, rather than the current Future Urban Development Area policy framework. The proposed subdivision would consist of single detached dwellings on municipal water and private septic systems. Access to the development will be provided via a single road, forming a new T-intersection with Old Highway 2.
Zoning Bylaw change
The subject property is currently zoned as Development Exception One (D-1) Zone. The Zoning By-law Amendment proposes to rezone the
subject lands to the Rural Residential Exception XX (RR-XX) Zone to permit a 29 lot subdivision on partial services, as well as several site specific zone provisions.
August 17, 2023 – Application to Quinte West for Official Plan Amendment for a proposed resort development at 1436-1476 Old Highway 2, which did not proceed
The proposed development is for a tourist resort development comprising multiple short-term accommodation buildings and accessory uses including a restaurant, lounge, spa, commercial market and events space, administration and maintenance uses. A hotel with 75 rooms, 75 rooms within ‘boutique inn’ buildings, and 50 cabins; resulting in a minimum of 200 rooms.
The property is currently developed with a single detached dwelling (unoccupied), a seasonal residential dwelling and a barn and a shed. The area surrounding the buildings appears to be a mix of agricultural fields and scrub lands. The subject property is serviced with municipal water and private waste water services.
The subject site has an area of approximately 8.7 hectares (21.5 acres) and frontage of approximately 260 metres on Old Highway 2 and a depth of approximately 245 metres. The property has approximately 377 metres of frontage on the Bay of Quinte. There are two existing accesses to the subject property along the frontage of Old Highway 2.
The purpose of the Official Plan Amendment is to permit, at a policy level, the tourist development. The Official Plan Amendment
seeks to redesignate the subject property from Future Urban Development Area to a new Site Specific Policy Area.The proposed development does not conform to the existing zoning.

March 30, 1994 – Purchase of 47 acres of land in Thurlow just north of the 401
In 1994, [Mac 5 Corp] purchased approximately 47 acres of raw land [just north of Highway 401] in what was then the Township of Thurlow. In 1998, it sought amendments to the Official Plan and zoning by-law to permit it to develop the land for commercial purposes. The defendant approved the proposed amendments on certain conditions, one of which was that the plaintiff construct sewer and water infrastructure at its own cost which would connect to the existing municipal system.
Activity
January 22, 2020 – Sued the City of Belleville to require homeowners to share development costs, but was dismissed
MAC 5 Corp. v. The Corporation of the City of Belleville, 2020 ONSC 440
Mac 5 Corp argued that homeowners on Cloverleaf Drive should have been required to enter into a cost-sharing agreement to reimburse the plaintiff for infrastructure costs (a sewer and water extension) before they connected to the municipal services. The City, however, did not require these homeowners to negotiate such an agreement, leading to the lawsuit.
The central issue was whether the Development Agreement required homeowners on Cloverleaf Drive to enter into cost-sharing agreements or if it only applied to other developers benefiting from the infrastructure.
The court ultimately found in favor of the defendant, ruling that the Development Agreement did not apply to homeowners, but rather to developers whose land would benefit from the infrastructure.
August 2016 – Fined $30,000 for environmental offenses
MAC 5 and its president, Arnold MacLauchlan, were convicted of five offences each for non-compliance with two Provincial Officer’s Orders under the Environmental Protection Act and the Ontario Water Resources Act.
